SoundBattly is a sound-imitation game. You may record or import short sounds, compare attempts on your device, create videos, and send unlisted challenge links. You remain responsible for every sound and recording you create, upload, or share.
1. Agreement and eligibility
These Terms form an agreement between you and SoundBattly, operated under the Arongame Studio name (“SoundBattly”, “we”, “us”). By using the website, app, or shared challenge service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
You must be at least 13 and old enough to consent to the service under local law. If you are a minor, you must have permission from a parent or legal guardian. The app is not offered as a children’s service.
2. The service
SoundBattly provides entertainment features including audio recording or import, on-device sound analysis and scoring, camera recording, video rendering, local collections, sharing through device tools, and unlisted challenge links. Scores are automated estimates for entertainment only; they are not scientific, medical, biometric identity, voice-authentication, or professional evaluations.
Features may change, be interrupted, or be discontinued. You are responsible for compatible equipment, internet access, backups, and permissions required by your device.
3. Your recordings and rights confirmation
You retain ownership of content you create. Before creating a shared challenge, you must confirm that you created the sound or have all rights, licenses, permissions, and consents necessary to record, upload, reproduce, and share it.
Do not assume that a clip is lawful merely because it is short. Music, radio, television, films, games, podcasts, social-media audio, performances, private conversations, and another person’s voice may be protected by copyright, performer rights, privacy, publicity, confidentiality, or other laws. You are responsible for obtaining permission when required.
4. Prohibited content and conduct
You may not use SoundBattly to create, upload, share, solicit, or promote:
- content that infringes copyright, trademark, performer, publicity, privacy, data-protection, confidentiality, or other rights;
- private conversations or identifiable voices recorded or shared without appropriate notice and permission;
- sexual exploitation or endangerment of minors, grooming, or any sexual content involving minors;
- pornographic content, non-consensual intimate material, or sexual harassment;
- threats, bullying, stalking, hate, targeted abuse, humiliation, impersonation, or encouragement of violence or self-harm;
- illegal activity, fraud, malware, attempts to bypass security, automated abuse, spam, or interference with the service;
- content that exposes sensitive personal information or creates a foreseeable risk of physical harm;
- misleading claims that a SoundBattly score proves identity, health, ability, or factual truth.
5. License needed to operate shared challenges
When you create a shared challenge, you grant SoundBattly a limited, non-exclusive, worldwide, royalty-free license to host, store, encode, reproduce, technically process, and transmit the sound and related metadata solely to operate, secure, moderate, and improve the shared-challenge feature. This license does not transfer ownership. It ends when the content is deleted, except for limited backup, security, legal, or dispute records that must reasonably remain.
6. Shared links are unlisted, not confidential
We do not intentionally place challenge links in a public feed or search catalog. However, anyone with the link may open, copy, record, or forward it. We cannot control recipients or copies already stored on their devices or third-party platforms. Do not use a shared link for confidential, sensitive, or access-controlled material.
7. Moderation, reporting, and deletion
Users can report shared challenges for infringement, privacy/voice concerns, abuse, child-safety concerns, or other violations. We may review, limit, hide, preserve, or delete content; disable links; resolve reports; cooperate with lawful authorities; and restrict abusive use. We are not required to pre-screen every upload, and moderation does not shift responsibility away from the person who uploaded it.
Creators can delete a challenge using the secret deletion credential stored on the creating device. Losing that device or credential may prevent self-service deletion; contact support for assistance. We may remove content without advance notice when reasonably necessary for safety, legal compliance, rights protection, or enforcement.
8. Copyright and other rights complaints
If you believe a shared challenge infringes your rights, use the in-app report function or email legal@soundbattly.com. Include the challenge URL or code, identification of the protected work or right, your contact details, an explanation of the issue, and a statement that the information is accurate and that you are the rights holder or authorized to act for them. We may request additional verification before acting.
9. Video and third-party sharing
When you export or share a video to TikTok, Instagram, YouTube, another app, or another person, you direct your device to send that content outside SoundBattly. The recipient’s terms and privacy practices apply. SoundBattly is not affiliated with or endorsed by those platforms merely because a system share option is available.
10. Premium and purchases
If Premium is offered, prices, billing periods, trials, and included features will be shown before purchase. Mobile purchases are processed by the applicable app store and may also be validated through RevenueCat. Store rules govern payment, cancellation, refunds, and subscription management. Deleting the app does not automatically cancel a store subscription.
11. SoundBattly intellectual property
The SoundBattly name, visual design, software, scoring implementation, graphics, and service content—excluding user content—are owned by us or our licensors and protected by applicable law. These Terms grant only a personal, limited, revocable, non-transferable right to use the service as provided. You may not copy, sell, reverse engineer where prohibited, scrape, or commercially exploit the service without permission.
12. Disclaimer
To the extent permitted by law, SoundBattly is provided “as is” and “as available”. We do not guarantee uninterrupted operation, preservation of local files, a particular score, availability of a shared link, or that content supplied by users is lawful or accurate. Nothing in these Terms excludes consumer guarantees or other rights that cannot lawfully be excluded.
13. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss; lost content, profits, opportunities, or reputation; third-party conduct; or unauthorized redistribution of a shared link. Where liability cannot be excluded, it is limited to the greater of the amount you paid SoundBattly during the twelve months before the claim or USD 50, without limiting non-waivable consumer rights or liability that law does not permit us to restrict.
14. Suspension and termination
You may stop using SoundBattly at any time and may delete local content through the app. We may suspend access, remove content, or discontinue service where reasonably necessary to enforce these Terms, protect users or rights holders, prevent abuse, address security risk, or comply with law.
15. Changes and applicable law
We may update these Terms as the service or law changes. We will publish the new effective date and request renewed acceptance for material changes where appropriate. Mandatory consumer protections and the courts available to you under applicable law are not displaced by these Terms. Otherwise, disputes are governed by the laws applicable to the operator of SoundBattly, excluding conflict-of-law rules.
